Bias of (Especially) Supreme Court Judges

Against the background of extensive jurisprudence, the article deals with the bias of judges, es¬pecially judges of the highest courts (including the Constitutional Court). It emphasizes the subjective and objective test of impartiality and lists a number of specific situations that may give rise to judicial bias. It divides these examples into individual types of relationships in which judges find themselves (judges and their colleagues, judges and other legal professions, judges and their decision-making activity, judges and public speaking, judges and their publishing and lecturing activities, judges and their past). At the end of the article, the author emphasizes that the problem of bias is very difficult to generalize, and the personal integrity of each judge is therefore key.
Czech original: Článek se na pozadí obsáhlé judikatury zabývá podjatostí soudců, a to zejména soudců nejvyšších soudů (včetně Ústavního soudu). Zdůrazňuje subjektivní a objektivní test nestrannosti a uvádí řadu konkrétních
situací, které mohou založit podjatost soudců. Tyto příklady rozděluje do jednotlivých typů vztahů, ve kterých se soudci nacházejí (soudci a jejich kolegové, soudci a jiné právnické profese, soudci a jejich rozhodovací činnost, soudci a veřejné vystupování, soudci a jejich publikační a přednášková činnost, soudci a jejich minulost). V závěru článku autor zdůrazňuje, že problém podjatosti se velmi obtížně zobecňuje a klíčová je proto osobnostní integrita každého soudce.
