This article summarises the experience with direct democracy in the Czech constitutional system, both at the national and local level. It therefore focuses on the development of efforts to introduce a general referendum into the constitutional system of Czech Republic. The article also focuses on challenges associ¬ated with direct democracy and, in particular, its pitfalls. The absence of constitutional regulation suggests that we are indeed living in a representative democracy in Czech Republic. If direct democracy were to speak into the constitutional text, the first thing to do would be to add regulation of local referendums. Other ele-ments of direct democracy really need to be carefully considered so that we do not end up with a dysfunc¬tional model without any accountability for governance.
Czech original: Tento článek sumarizuje zkušenosti s přímou demokracií v českém ústavním systému, a to jak na celostátní, tak na místní úrovni. Zaměřuje se tedy na vývoj snahy prosadit obecné referendum do ústavního pořádku a podává i zprávu o úpravě místních referend. Pojmenovává také výzvy s přímou demokracií spojené a zejména pak její rizika. Absence ústavní úpravy nám napovídá, že v České republice žijeme skutečně v zastupitelské demokracii. Pokud by měla přímá demokracie promluvit do ústavního textu, v prvé řadě by bylo vhodné doplnit úpravu místních referend. Jiné prvky přímé demokracie je potřeba opravdu důsledně zvážit, aby nevznikl nefunkční model bez jakékoliv odpovědnosti za vládnutí.
