Psychedelic-Assisted Psychotherapy and Acceptable Risk

The therapeutic potential of psychedelics is a highly debated topic worldwide. From a professional point of view, there is no doubt about the therapeutic potential of these substances. However, their use in the treatment of mental health problems is complicated due to their legislative classification as illegal controlled substances with the strictest control regime, which precludes them from being medicines. In spite of this fact, various ways are being searched to use psychedelics legally in a medical context, as psychedelic-assisted psychotherapy. The aim of this text is to consider whether the administration of psychedelics in the context of therapy fulfils the legal conditions of acceptable or tolerable risk as a circumstance excluding illegality. The text will first focus on the analysis of the concept of acceptable risk and then on the issue of psychedelics and psychedelic-assisted therapy. It will then assess whether the administration of psychedelics, classified as illegal psychoactive substances, in the therapeutical setting can be interpreted in terms of acceptable risk, and thus exclude the criminalization of such an act, which would otherwise fulfill the offence of illicit production and other disposal of narcotic and psychotropic substances and poisons under Section 283 of the Czech Criminal Code.
Czech original: Terapeutický potenciál psychedelik je celosvětově aktuálně velmi diskutovaným tématem. Z odborného hlediska není o léčebném potenciálu těchto látek pochyb. Využití v léčbě duševních obtíží však komplikuje jejich legislativní řazení mezi nelegální návykové látky s tím nejpřísnějším režimem kontroly, jenž vylučuje, aby byla léčivy. Navzdory tomu jsou hledány různé cesty, jak psychedelika legálně užívat v medicínském kontextu ve smyslu psychedeliky asistované psychoterapie. Cílem tohoto textu je úvaha, zda podání psychedelik v rámci terapie naplňuje zákonné podmínky přípustného rizika jako okolnosti vylučující protiprávnost. Text se nejprve zaměří na výklad institutu přípustného rizika a dále pak na problematiku psychedelik a psychedeliky asistované terapie. V návaznosti na to pak provede zhodnocení, zda je podání psychedelické, tj. návykové, respektive omamné a psychotropní látky v rámci terapie možno interpretovat v intencích přípustného rizika, a vyloučit tedy trestnost takového jednání, jež by jinak naplňovalo skutkovou podstatu trestného činu nedovolené výroby a jiného nakládání s omamnými a psychotropními látkami a jedy dle § 283 trestního zákoníku.
