International Delimitation of Maritime Zones (2010–2016)

The article analyzes the later development in the international delimitation of maritime zones after the breakthrough decision Maritime Delimitation in the Black Sea (Romania v. Ukraine, 2009). In this later period, a handful of important jurisprudence, critically followed by scholars, enriched the understanding of some most controversial areas in the law of the sea, namely the complex delimitation of small islands and the delimitation of the continental shelf beyond 200 nautical miles from baselines. The international jurispru¬dence can be characterized by an innovative and open-minded approach, best illustrated by the application of the well-established equidistance line (nowadays considered as being part of customary law together with the special circumstances method), but also older methods of delimitation – the angle-bisector method and the equiratio method.
Czech original: Článok analyzuje vývoj v medzinárodnej delimitácii námorných zón po prelomovom rozsudku Maritime Delimitation in the Black Sea (Romania v. Ukraine, 2009), počas ktorých došlo k ďalším významným rozhodnutiam, ktoré významnou mierou obohatili aplikačnú prax jednak riešením nových kontroverzných tém medzinárodného morského práva – námorná delimitácia najmenších ostrovov a delimitácia kontinentálneho šelfu za hranicou 200 námorných míľ od základných línií. Judikatúra sa vyznačovala inovatívnym prístupom, použitím starej a osvedčenej metódy equidistancie (dnes už považovanej za medzinárodné obyčajové právo spolu s relevantnymi okolnosťami), ale aj staronových metód uhlovo-bisektorovej a equiračnej delimitačnej metódy.
