The Statute of Limitations of a Right Granted by a Foreign Court Decision or a Foreign Arbitral Award

The article deals with the issue of determining the relevant statute of limitations and thus the limitations time in the context of cross-border enforcement of judgments and arbitral awards. The sources of private international law, by which the Czech courts are bound, do not, with the exceptions discussed in the article, contain explicit provisions stipulating the limitations time of enforcement of foreign decisions. The article seeks an answer to the question under which law the court of the state in the territory of which enforcement of the foreign decision is sought assesses the statute of limitations on the objection of the judgment debtor. Whether the court in the state of enforcement applies its national rules or whether it applies the rules of lex causae. And whether the statute of limitations in the law of the state in whose territory the decision was given may also play a role.
Czech original: Článek se zabývá problematikou určování relevantní právní úpravy promlčení, a tedy i délky promlčecí lhůty v souvislosti s přeshraničním výkonem soudních rozhodnutí a rozhodčích nálezů. Prameny mezinárodního práva soukromého, kterými jsou vázány české soudy, neobsahují, až na výjimky, které jsou v článku pojednány, výslovnou úpravu promlčení v případě nuceného výkonu práva již přiznaného cizozemským rozhodnutím. Článek hledá odpověď na otázku, podle jakého práva soud státu, na jehož území je výkon cizího rozhodnutí navrhován, promlčení k námitce ze strany povinného posuzuje. Zda soud ve státě výkonu vychází ze své národní úpravy promlčení, nebo aplikuje lex causae, a zda může hrát roli rovněž úprava promlčení v právním řádu státu, na jehož území bylo rozhodnutí vydáno.
